Which Schengen Country Should You Apply Through? The Main Destination Rule

The Short Answer

You must apply through the Schengen country where you will spend the most nights. If two countries tie, apply through the one you will enter first. The rule is set by the Schengen Visa Code (Regulation (EC) No 810/2009, Article 5) and is enforced by every Schengen embassy. Getting this wrong does not just slow your application down; it can result in refusal on procedural grounds.

Which Schengen Country Should You Apply Through? The Main Destination Rule

You apply for a Schengen visa through the country where you will spend the most nights. This is the main destination rule, and it applies to every UAE resident regardless of nationality or travel purpose.

If two countries share equal nights, the country of first entry decides. The rule is set out in Regulation (EC) No 810/2009 (the Schengen Visa Code), Article 5 .

What exactly is the main destination rule?

The main destination rule is a jurisdiction rule. It determines which Schengen member state is responsible for processing your visa application.

Each Schengen embassy only has authority to issue visas for trips where that country is the primary destination. Applying to the wrong embassy wastes your appointment slot, your documents, and your visa fee.

The rule is straightforward: count the nights you will spend in each Schengen country on your itinerary. The country with the highest night count is your main destination and the one you must apply through. If France has 5 nights, Germany has 3, and Italy has 2, you apply to the French embassy or VFS Global France in Dubai or Abu Dhabi.

What happens when two countries have the same number of nights?

When your itinerary produces a tie, the Schengen Visa Code directs you to apply through the country of first entry. If you are spending 4 nights in Spain and 4 nights in Portugal, and you fly into Madrid first, Spain is the responsible state. First entry is defined as the first Schengen border crossing on that trip, not the first country you book a hotel in.

This matters practically because it affects which visa centre you use in the UAE. Spain's Schengen applications are filed through BLS International, while France, Germany, and Italy use VFS Global. Both have centres in Dubai and Abu Dhabi, but they are different operators with different appointment slots and document checklists.

How do I count nights correctly?

Count only nights within the Schengen Area. Nights spent outside Schengen, for example a two-night stop in London or a cruise day at sea with no Schengen port, do not count toward any country's total. Transit time also does not count unless you clear immigration and enter the territory.

Use your confirmed hotel bookings to build the count. If you have not booked hotels yet, your travel itinerary must still show projected nights per country so the embassy can assess jurisdiction.

A flight reservation showing your entry and exit dates from each country is the minimum proof needed at the application stage. If you have not bought flights yet, a flight reservation with a real PNR from Dummy Ticket 365 (from USD 13) serves as proof of travel without committing you to a ticket purchase before your visa is granted.

What if I am only transiting through a Schengen country?

Transit through a Schengen airport without passing through passport control is an airport transit, and it does not make that country your main destination. However, if you clear immigration even briefly, those hours count as a night only if you also sleep there. A two-hour layover in Frankfurt where you stay airside does not require you to apply through Germany.

If you hold a nationality that requires an Airport Transit Visa (ATV) for Schengen airports, that is a separate visa category and a different process. Most UAE residents on non-GCC passports should check their ATV requirement before booking a connecting flight through a Schengen hub.

Which Schengen countries are handled by which UAE visa centres?

In the UAE, Schengen applications are split between two operators. VFS Global handles applications for France, Germany, Italy, the Netherlands, Switzerland, and several other Schengen states.

BLS International handles Spain and a smaller number of countries. Both operators have branches in Dubai and Abu Dhabi.

The embassy responsible for your application is determined by your main destination country, and that country's designated visa centre is the only place you can submit. You cannot walk into VFS Global for a France application if Spain is actually your main destination and BLS is the right operator. Getting this wrong means the application will be rejected at submission before it even reaches an embassy officer.

What documents prove my main destination?

  • Hotel reservations or accommodation confirmations showing check-in and check-out dates for each country
  • A flight itinerary or verified flight reservation showing entry and exit dates per country
  • A travel itinerary document listing each destination, dates, and planned activities
  • Tour booking confirmations if travelling on a package
  • Cruise itinerary if the trip includes sea travel between Schengen ports

Every document in this list must be consistent. If your hotel bookings show 6 nights in Italy but your flight lands in Germany, the embassy will want a clear explanation of how you reach Italy. Inconsistencies do not cause automatic refusal, but they generate follow-up questions and slow processing.

Why do Schengen applications get refused for jurisdiction reasons?

Refusals on jurisdiction grounds happen when an applicant submits to the wrong embassy entirely. For example, applying to the French consulate when the itinerary clearly shows Spain as the main destination.

The French consulate will decline jurisdiction and refer the applicant to Spain. This is not a full refusal with a visa denial stamp, but it wastes weeks and requires starting the process again with BLS International for Spain.

A more damaging scenario is an applicant who deliberately applies through the country they believe is easier to get a visa from, even though it is not their main destination. Embassies check itineraries carefully, and applying to an easier embassy when another country has more nights is a misrepresentation.

That can result in a formal refusal with a reason code citing incomplete or false information, which then has to be declared in future applications. Our guide on what to do if your Schengen visa is delayed past your travel date covers what to do if processing runs long, but the better approach is to avoid procedural mistakes in the first place.

What if my plans change after I apply?

If your itinerary changes significantly after you submit but before the visa is issued, contact the embassy or visa centre immediately. A change that shifts your main destination from the country you applied through to another Schengen state may require you to withdraw the application and reapply through the correct embassy. That is a painful outcome, especially if you are close to your travel date.

Minor changes, such as swapping two nights between cities in the same country, do not affect jurisdiction and do not need to be reported. The test is always whether the country of application is still the main destination under the revised itinerary.
